1. Estado de Necesidad
El estado de necesidad se define como: «eximente que ampara a quien, en
una situación de necesidad, para evitar un mal propio o ajeno no consistente en una
agresión ilegítima tiene que causar otro mal, siempre que este no sea mayor que el
que trata de evitar, que no haya provocación intencionada del estado de necesidad y
que la profesión o cargo del sujeto no lo obligue a sacrificarse»330.
Describe la ley penal, el estado de necesidad de la siguiente manera:
CPCOL
• Art. 32. 6. Se obre por la necesidad de defender un derecho propio o ajeno
contra injusta agresión actual o inminente, siempre que la defensa sea propor-
cionada a la agresión.
CPE
• Art. 20. 5.º El que, en estado de necesidad, para evitar un mal propio o ajeno
lesione un bien jurídico de otra persona o infrinja un deber, siempre que con-
curran los siguientes requisitos:
