INTRODUCTION
Democracy, as Winston Churchill said, is “the worst system, but so far
nothing better has been invented2. The principle of the tenure of public authorities
is an integral part of this system3. The core of this principle is the principle of
the creation of power through periodic free elections. This is best explained by
a quote by Adhemar Esmein, who wrote that “all power is granted directly or
indirectly by the nation, either directly or indirectly, for a limited period of time,
so that the authority of the nation is constantly kept active and is revealed at
periodic intervals”4. The formula of representative democracy thus implemented
has, among many objectives, one key one, namely, the attribution of a specific
responsibility to the representative towards the nation. In this way, voters can, in any
subsequent election, refuse to grant power of attorney to their current representative
