[308] Capítulo XXIII, de la obediencia que el Magistrado debe a las leyes del soberano & de la forma de estudiarlas.
[310] [...] si se me preguntase [311] ¿cuál es el mayor bien de la sociedad?, respondería: un buen magistrado y si me preguntan ¿qué es un buen magistrado?, respondería que reúne tres cosas: la primera, la observación de la ley, la segunda, la observación de la ley y la tercera, aún la observación de la ley. [...] Porque, en fin, si el Magistrado carece de la obediencia que le debe al soberano, al no observar la ley, ¿no es injusto querer que el pueblo le obedezca? En tanto que el fundamento de la obediencia que le debe el pueblo es la voluntad del soberano que le ha establecido Juez para juzgar a las gentes según la ley.
[450] Capítulo XXXIII, qué crimen cometen los jueces al violar las ordenanzas o al despreciarlas.
[454] Para calificarlo como crimen de lesa Majestad, no hay más que saber qué es la soberanía. La soberanía es el poder absoluto y perpetuo de una República. Es así como lo define Bodino y esta soberanía se expresa en una sola palabra con el término majestad. De modo que aquél que viola las Leyes, viola la soberanía y viola la Majestad. Si la ley según el mismo Bodino no es más que la orden del soberano empleando su poder, aquel que viole la ley, desobedece a la orden del soberano que emplea su poder y así, peca evidentemente contra la soberanía y contra [455] la Majestad. [...]
[456] Si el Magistrado, digo, quiere ser obedecido por los particulares, ¿con qué derecho puede pretenderlo cuando es él quien no obedece al soberano? No tiene más autoridad que la que al soberano le place comunicarle y, puesto que él mismo no reconoce en la ley la...
