Entre las Leyes, las hay que tienen por objeto el bien general y común de la sociedad y hay otras que no conciernen más que los intereses de los particulares. Una distinción tan natural ha formado con el transcurrir del tiempo lo que denominamos Derecho público y Derecho privado. [...]
[2] Este nombre de Política, que ha pasado de los griegos a los romanos, ha mantenido hasta nuestros días este mismo significado, pero como encierra en sí todas las diferentes formas de gobierno y lo hay de varios tipos, es equívoca. Lo tomamos a veces por el gobierno general de todos los Estados, bajo cualquier forma que haya establecido y en este sentido se divide en Monarquía, Aristocracia, Democracia [...]. tica, política civil y política militar. Pero ordinariamente en un sentido más limitado, se toma por el orden público en cada villa y el uso lo ha mantenido de tal forma con este significado, que todas las veces que se pronuncia de forma explícita y sin continuación, no se entiende más que en su primer sentido.
[255] Libro I, Capítulo XIV, de la obediencia debida a los Magistrados. La ley, sin el Magistrado, es un cuerpo sin alma que no sirve de nada al gobierno. Y el magistrado, hombre de bien, sin leyes escritas, siendo él mismo una ley viviente, no dejaría de gobernar y de hacer a la Ciudad feliz. Es por ello que en una República excelente, de entrada se aplican a formar buenos magistrados, más que a hacer buenas leyes.
Pero cuando hay leyes establecidas, los magistrados deben conformarse con las mismas y prestar atención para que no sean violadas. La República está bien próxima de su fin cuando no son las leyes las que controlan a los magistrados, sino los magistrados a las leyes.
Como el poder soberano del príncipe es un rayo y un reflejo del poder todopoderoso de Dios, también el poder de los magistrados es una emanación del poder absoluto del príncipe. De ahí viene el que, cualquiera que simule hacer acto de Magistrado, o de ejercer de forma alguna el poder público, atenta contra la soberanía y se hace culpable de crimen de lesa Majestad.
