[48] Capítulo V, de los oficiales de Justicia. De los Parlamentos & otras cortes soberanas. De los presidiales. Del Consejo del Rey. Medios útiles para el bien del Estado.
Si la buena fe estuviese al completo en todos los hombres y si cada uno de ellos tuviese una ley en sí mismo, [...], no habría necesidad de leyes ni de magistrados, para conservarlos en una tranquilidad estable. Pero desde que la naturaleza se corrompió, no consultamos más esta justicia original, que es inseparable de la razón y que nos presiona interiormente y sin relajación de dar a cada uno lo que le pertenece, a una igualdad similar a la que querríamos para nosotros mismos. Siempre el amor propio, a menudo la necesidad, a veces el odio, la avaricia o cualquier otra pasión nos ciegan, y nos hacen violar una ley tan santa y tan equitativa, de forma, que nos dejamos llevar a extremos difíciles de creer. Nos damos igualmente al artificio y a la violencia para contentar a nuestra injusticia y nuestros desarreglos, de forma que fue conveniente que los sabios hiciesen una nueva razón, que han [49] llamado Ley y, como las leyes son inútiles si no están armadas con un castigo

para sancionar a aquellos que las desprecian y ya que ellas no tienen nada de vivo y de animado, se ha creado a los magistrados, que pronuncian los oráculos, que las hacen actuar y que mantienen su autoridad. Estos oficiales son elegidos entre las gentes de bien y los más lúcidos del Estado y si las repúblicas están bien ordenadas, se prefiere [para el cargo] ordinariamente a los ricos por encima de los pobres, a los nobles sobre los plebeyos, porque se supone que tienen tanta virtud y tanta luz que, en consecuencia, son incapaces de ciertas bajezas a las que la necesidad y la baja extracción podrían llevar [a los demás], así las gentes de justicia, que en Francia llamamos gens de robe, son ciertamente necesarios para la república.
[50][...] parece que los Parlamentos han tratado de insinuar en la mente de las gentes poco informadas, que componían un cuarto orden en el reino, no sólo separado de los otros tres sino superior en todo, por su soberanía y por su posición en donde han deliberado sobre la voluntad del Rey y si no se les desengañaba de esta opinión, podrían llamar al mismo error al resto de cortes soberanas y los demás oficios de judicatura [...].
