La reflexión sobre la paz es inseparable del estudio de los distintos tipos de violencia que sedan en nuestros tiempos y sobre las formas de erradicarlos.121Es importante ubicarnos dentro de un marco de posibilidades fácticas. Es importante alejarse de las utopías aunque sean estas el impulso creador de la voluntad impetuosa. La paz más allá de la ausencia de guerra debe ser vista como una necesidad intrínseca deontológica de la defensa de los valores de la verdadera democracia, la universalidad de los Derechos Humanos y el Estado de Derecho. Es una obligación impetuosa superar el relativismo, la indiferencia de la convivencia, olvidado y descartando el etnocentrismo122Hay que, como indica el profesor Ballesteros, sustituir el concepto de seguridad nacional, que sacrifica las libertades y los derechos y la dignidad humanos, por el de seguridad humana, la cual guarda relación con la calidad de vida para todos. Erradiquemos el odio, como elemento de la paz.123
Existe una base común que permea el orbe internacional. El derecho Internacional, bien consuetudinario, bien consensual, bilateral, multilateral, o universal. Partiendo de ese comienzo, seremos los caminantes que hacen camino.
A pesar de las prohibiciones jurídicas internacionales, la tortura sigue practicándose en la mayoría de los países. En general, el objetivo es quebrar a la víctima y, en menor medida, castigarla. A veces sucede que personas, grupos, funcionarios recurren a la tortura para intimidar o presionar a una persona o para obtener información. En el derecho internacional humanitario, a diferencia del derecho de los derechos humanos, la presencia de un funcionario estatal o de toda otra persona que tenga autoridad no es necesaria para que el proceso sea considerado como tortura. En todo caso, la doctrina del "acto del Estado", por la que un individuo estaría protegido de la responsabilidad penal por un acto que haya cometido en nombre del Estado o como funcionario de éste, no constituye una defensa en el derecho penal internacional. La tortura viola la concepción fundamental acerca de cómo deben ser tratadas las personas y no respeta ni los tratados ni los estatutos. La tortura es temida por todos, aliena a todos y perturba a la comunidad. Si bien el empleo de la tortura es enfáticamente negado en todos los Estados y por todos los perpetradores, la cuestión de las justificaciones implícitas de la tortura y los tratos inhumanos resurge en todas las sociedades...
