I. TEORÍAS TRADICIONALES Y TEORÍAS FUNCIONALES
DE LEGITIMACIÓN DEL DERECHO PENAL
Toda discusión sobre la legitimación del Derecho penal debe partir de
una decisión básica. A saber: debe optar entre el entendimiento tradicional
del Derecho penal y el funcionalismo jurídico-penal, sobre todo tal y como
se defiende por Jakobs y sus discípulos 1. En mi opinión, las diferencias que
existen entre estas dos grandes direcciones de la dogmática penal alemana
son más profundas que las existentes entre la noción alemana de bien jurí-
dico y el harm principle angloamericano. Al menos en su función limitado-
ra del Derecho penal, estos dos principios son deudores del pensamiento
de la Ilustración y del liberalismo político 2. El funcionalismo penal, por el
contrario, se remite al funcionalismo sociológico en su versión luhmanniana
y, desde hace no tanto, también a Hegel 3. Para la dogmática tradicional el
