ABSTRACT: In late 2020 the Spanish government approved the Anteproyecto

de Ley de Medidas de Ef‌iciencia Procesal del Servicio Público de Justicia, within

which there are rules to enforce the use of Alternative Dispute Resolutions. Italy

implemented (mitigated)mandatory commercial mediation in 2010 and is planning

to enhance its use in 2021. A brief comparison of some aspects of the two regu-

lations may be useful.
