ISSUE

Whether our client, a German company with a Pennsylvania fran-

chise, can acquire personal jurisdiction over a California company

in Pennsylvania courts based upon downloads of music from that

California company’s website.

BRIEF ANSWER

Probably. Personal jurisdiction can be acquired over a company

that engages in Internet sales through its website when those goods

are purchased by residents of the state in which jurisdiction is sought.

The key question will be whether music downloads are considered

goods.
