¿Cabe hallar razones más allá del Derecho positivo para decidir qué con-
ductas deben castigarse y cuáles no? Esta es la pregunta central que en el
fondo se plantea la teoría del bien jurídico en el ámbito germano, siempre
y cuando pretenda ser una teoría crítica y no simplemente sistematizadora.
Pero indagar sobre qué debería ser castigado penalmente es también un ob-
jetivo del harm principle desarrollado en el ámbito anglosajón.
Conforme al harm principle, por ejemplo en la formulación hoy en día
frecuentemente cuestionada de Joel Feinberg, un hecho es por regla general
merecedor de pena si lesiona a una o más personas en sus derechos, teniendo
en cuenta sus welfare interests, los presupuestos básicos de su bienestar 1.
Pero además, según la concepción de Feinberg, en determinadas condicio-
nes también puede imponerse una pena con independencia del harm princi-
ple si se ofende a alguien, es decir, si se menoscaban sus sentimientos (offense
principle) 2. Sin embargo, en el marco de la teoría del bien jurídico —en tanto
se comprometa a una función crítica—, los objetos, realidades, funciones,
etc., merecedores de protección penal a menudo se delimitan de los no me-
recedores negativamente, partiendo de que ni los meros sentimientos ni las
posiciones exclusivamente morales, así como tampoco las unidades funcio-
nales a partir de un determinado nivel de abstracción, merecen protección
jurídico-penal 3.
