RESUMEN: El presente ensayo aborda de ma-

nera interdisciplinaria y transdisciplinaria las

relaciones entre jurisdicción, como poder y

deber del Estado de tutelar judicialmente los

derechos a través de la interpretación de los

textos normativos, y el apabullante uso de la

inteligencia articial como mecanismo faci-

litador de producción en serie y articial de

las mismas decisiones judiciales que tutelan

derechos. El problema pasa por poner en

destaque el uso desmedido de estas tecnolo-

gías y proponer como elemento catalizador

la regulación de dicho mecanismo y la deli-

mitación de los ámbitos o espacios en el que

el juez podrá valerse de tal método.

ABSTRACT: This essay addresses in an interdis-

ciplinary and transdisciplinary methodology

the relationship between adjudication [as the

public power to judicially protect rights] and

the overwhelming use of articial intelligence

as a facilitating mechanism for the serial and

articial production of the very judicial deci-

sions that protect these rights. The problem

we will try to describe and solve deals with the

excessive use of these technologies and the

potential threat to humanity involving adjudi-

cation. We seek to shed a light on a potential

solution by regulating and delimitating the

judicial tasks, scopes or spaces where judges

could be allowed to use this method.

Will AI replace adjudication?

Answer: It is unlikely that artif‌icial intelligence (AI)

will completely replace adjudication, which is the le-

gal process of resolving disputes and making decisions

in court or administrative proceedings.

While AI has advanced signif‌icantly in recent years and

can automate certain tasks, such as document review

and legal research, it still lacks the judgment and reason-

ing abilities that are necessary for making complex legal

decisions. Adjudication requires a deep understanding of

the law, legal precedents, and the facts of each individual

case, as well as the ability to weigh competing interests

and consider ethical and moral considerations.

Furthermore, the legal system is deeply embedded in

social and political systems, and any changes to the

legal process would require signif‌icant societal and in-

stitutional changes.

In summary, AI may assist and streamline some as-

pects of adjudication, but it is unlikely to fully replace

human judges and decision-makers.1
