La ley sálica, por la que se excluye a las mujeres de la corona de Fran-cia, fue la norma establecida y considerada como esencialmente característica de la monarquía francesa. Tras la muerte de Enrique III, mediante el empleo de esta norma, el designado al trono sería finalmente (y tras la muerte de otros candidatos) Enrique de Navarra, protestante, con prevalencia sobre Isabel Clara Eugenia que habría sido la más próxima al difunto rey de no haber sido por esta peculiaridad concerniente al género. ¿Qué motivos impulsaron a tratar esta ley como fundamental para el Estado? Hay que advertir que la norma era anterior pero en este periodo y frente a la tesitura reinante alcanzó una importancia muy superior a la que tradicionalmente tuvo, elevándose así a ley fundamental del reino.
Como recuerda Giesey, esta ley fue muy celebrada, con los primeros Borbones precisamente, pero poco a poco se fue demostrando que la importancia de esta regla en tiempos anteriores fue mucho menor79. El mismo tipo de controversia se dio en tiempos de Felipe de Valois, lo que hace suponer que el trasfondo político de tal norma la rebajaba al común denominador de las leyes políticas, alejándola de su origen supuestamente divino y fundamental. Estas son las circunstancias, conocidas desde 1584, en las que Pierre de Belloy, "buen francés" como él mismo se denominaba y politique, escribe sus discursos al respecto. Para Viennot, el texto de Guyart es fabuloso en el sentido más fantasioso del término80. La historia de la Ley sálica está, para este autor, escrita sin el más mínimo atisbo de controversia desde época romana en la que ya los latinos se habrían percatado del carácter divino de esta ley.
