Presidente de la corte europea de derechos humanos resalta en la oea semejanzas entre los sistemas de derechos humanos interamericano y europeo

El Presidente de la Corte Europea de Derechos Humanos, Juez Nicolas Bratza, fue recibido hoy en una sesión del Consejo Permanente de la Organización de los Estados Americanos (OEA) en la que resaltó que “la universalidad de los derechos humanos fundamentales y el carácter trascendente de los valores que los sustentan, son el motivo y el propósito de los sistemas desarrollados en Europa y en América, los cuales cuentan con objetivos, lenguaje y enfoques comunes”.
En su exposición ante los delegados del Consejo, el Juez Bratza presentó un panorama general del sistema de derechos humanos europeo, su historia, composición, regulación, y evolución. Habló acerca de la creación de la Corte Europea de Derechos Humanos, basada en Estrasburgo, Francia, comentando que al entrar en vigor en 1998 el Protocolo 11 de la Convención Europea en la materia, se rediseña la Corte como “un órgano de tiempo completo al que pueden acceder directamente los solicitantes, lo cual constituyó un importante avance para los derechos humanos en Europa, ya que se da en un momento de grandes cambios, cuando el Consejo de Europa crecía rápidamente en su número de miembros en los años posteriores al colapso de los regímenes totalitarios de Europa”.
El Juez Bratza se refirió igualmente a algunos retos que el Tribunal enfrenta en la actualidad enfatizando en el alto número de casos pendientes. “tenemos 150 mil aplicaciones pendientes ante la Corte, que son mucho más de lo que podemos llegar a manejar, esta es una tendencia en aumento que se ha venido dando durante más de 30 años”, informó y explicó las medidas adoptadas para manejar este y otros desafíos del quehacer de la institución, entre los que destacó el trabajo conjunto con las jurisdicciones nacionales a fin de acelerar los procesos y fomentar la solución amistosa.
Al aludir a las similitudes y la relación entre la Corte Europea y la Corte Interamericana, el magistrado británico dijo que “a pesar de la distancia física entre San José y Estrasburgo, a lo largo de varios años ambos tribunales han mantenido un contacto directo” y resaltó la participación de la Corte Interamericana en conferencias...
