AMENDMENTS TO THE RULES OF THE
INTERNATIONAL TRIBUNAL FOR THE LAW OF THE SEA
as adopted by the Tribunal on 17 March 2009
The Tribunal,
Acting pursuant to article 16 of the Statute of the International Tribunal for the
Law of the Sea, Annex VI to the United Nations Convention on the Law of the
Sea,
Adopts the following amendments to the Rules of the Tribunal of
28 October 1997:
(i) Article 113, paragraph 3 shall be amended to read as follows:
“Unless the parties agree otherwise, the Tribunal shall determine
whether the bond or other financial security shall be posted with the
Registrar or with the detaining State.”
(ii) Article 114, paragraph 1 shall be amended to read as follows:
“If the bond or other financial security has been posted with the
Registrar, the detaining State shall be promptly notified thereof.”
(iii) Article 114, paragraph 3 shall be amended to read as follows:
“The bond or other financial security shall be endorsed or transmitted,
to the extent that it is not required to satisfy the final judgment, award
or decision, to the party at whose request the bond or other financial
security is issued.”
Decides that these amendments enter into force forthwith.
