The Term “Space Object” and its Legal Status

Modern studies in space require clarication of the term of “space object.” Because, for example,

the ontology of the term of “space object” can be considered a) as from the point of view of astronomical

approaches that include astrophysical identiers, design specications, components, subsystems,

capabilities, vulnerabilities, origin, mission, elements of the orbit; b) both in terms of space law, where

the term “space object” has a dierent meaning. This is an articial object created by a person that

can create emergency situations, harm human health, etc. As a holistic property complex consisting of

facilities and equipment for the assembling, preparation and launching of spacecraft it should be subject

to the regime of real estate for the state to control its circulation.

Термін «космічний об’єкт» та його правовий статус

Сучасні дослідження в космосі потребують уточнення поняття «космічний об’єкт». Тому

що, наприклад, онтологію поняття «космічний об’єкт» можуть розглядати а) як з точки зору

астрономічних підходів, що включають астрофізичні ідентифікатори, специфікації дизайну,

компоненти, підсистеми, можливості, вразливість, походження, місії, елементи орбіти; б) так і

з точки зору космічного права, де термін «космічний об’єкт» має інше значення. Це вже штучний

об’єкт, створений людиною, що може створювати аварійні ситуації, зашкодити здоров’ю

людини та ін. Як цілісний майновий комплекс, що ск ладається зі споруд і технічних засобів для

збирання, підготовки та запуску космічних апаратів на нього повинен поширюватися режим

нерухомого майна для здійснення з боку держави контролю за його обігом.
