The European Court of Human Rights (Third Section), sitting on 21 April 2015 as a Committee composed of:

Having regard to the above application lodged on 17 March 2014,

Having regard to the formal declarations accepting a friendly settlement of the case,

Having deliberated, decides as follows:


The applicants, Mr Alexandru Simionovici and Ms Maria Simionovici, are Romanian nationals, husband and wife, who were born in 1944 and 1951 respectively and live in Botoșani.

The Romanian Government (“the Government”) were represented by their Agent, Ms C. Brumar, from the Ministry of Foreign Affairs.

The applicants complained under Article 6 § 1 of the Convention about the length of the criminal proceedings in which they were involved. The complaint was communicated to the Government on 23 October 2014.

On 14 January 2015 and 18 February 2015 the Court received friendly settlement declarations signed by the parties under which the applicants agree to waive any further claims against Romania in respect of the facts giving rise to this application against an undertaking by the Government to pay them jointly EUR 3,000 (three thousand euros) to cover any pecuniary and non-pecuniary damage as well as costs and expenses, which will be converted into Romanian lei at the rate applicable on the date of payment, and will be free of any taxes that may be applicable.
