RECENT ILLEGITIMATE SUPREME COURT DECISIONS IN THE BOLIVARIAN REPUBLIC OF VENEZUELA1/


(Adopted by the Permanent Council at its virtual special meeting held on J. 26, 2020)



THE PERMANENT COUNCIL OF THE ORGANIZATION OF AMERICAN STATES,


CONSIDERING that the Charter of the Organization of American States recognizes that representative democracy is an indispensable condition for the stability, peace, and development of the region;


REAFFIRMING that the peoples of the Americas have a right to democracy and their governments have an obligation to promote and defend it, as provided in Article 1 of the Inter-American Democratic Charter;


CONSIDERING that the Inter-American Democratic Charter provides that: respect for human rights and fundamental freedoms, access to and the exercise of power in accordance with the rule of law, the holding of periodic, free, and fair elections based on secret balloting and universal suffrage as an expression of the sovereignty of the people, the pluralistic system of political parties and organizations, and the separation of powers and independence of the branches of government are essential elements of representative democracy;


NOTING that resolution CP/RES. 1117 (2200/19), adopted on January 10, 2019, resolved: "To not recognize the legitimacy of N.M.’s new term as of the 10th of January of 2019", and called for "new presidential elections with all necessary guarantees of a free, fair, transparent and legitimate process to be held at an early date attended by, international observers”;


RECALLING that resolution CP/RES 1143 (2269/20), adopted on January 10, 2020, resolved to renew the call for a prompt return to democracy in Venezuela, and in this regard, reaffirmed the need to hold inclusive, free, fair and transparent presidential elections, conducted by a renewed and independent National Electoral Council, and a renewed and independent Supreme Court of Justice, and with the presence of independent international observers;



TAKING INTO ACCOUNT that the National Assembly of the Bolivarian Republic of Venezuela is the only democratically elected institution in Venezuela;


RECALLING that both the United Nations High Commissioner for Human Rights and the Inter-American Commission on Human Rights have repeatedly denounced the continued...
