Os Estados membros do Conselho da Europa, signatários do presente Protocolo à Convenção de salvaguarda dos Direitos Humanos e das Liberdades Fundamentais, assinada em Roma no dia 4 de novembro de 1950 (doravante denominada “Convenção”),
Considerando que os desenvolvimentos advindos dos diversos Estados membros do Conselho da Europa exprimem uma tendência geral a favor da abolição da pena de morte,
Estão de acordo com o que segue:
A pena de morte é abolida. Ninguém poderá ser condenado a tal pena nem ser executado devido a esta pena.
Um Estado pode prever em sua legislação a pena de morte para os atos cometidos em tempo de guerra ou de perigo iminente de guerra; uma tal pena somente será aplicada nos casos previstos por esta legislação e conforme às suas disposições. Este Estado irá comunicar ao Secretariado Geral do Conselho da Europa as disposições pertinentes da legislação em causa.
Nenhuma derrogação será autorizada às disposições do presente Protocolo ao título do artigo 15 da Convenção.
