Os Estados membros do Conselho da Europa, signatários do presente
Protocolo,
Convencidos de que o direito de toda pessoa à vida é um valor fundamental na sociedade democrática, e que a abolição da pena de morte é essencial à proteção deste direito e ao pleno reconhecimento da dignidade inerente a todos os seres humanos;
Desejando reforçar a proteção do direito à vida garantido pela Convenção de salvaguarda dos Direitos Humanos e das Liberdades Fundamentais, assinada em Roma no dia 4 de novembro de 1950 (doravante denominada “Convenção”),
Notando que o Protocolo n. 6 à Convenção concernente à abolição da pena de morte, assinado em Estrasburgo em 28 de abril de 1983, não exclui a pena de morte por atos cometidos em tempo de guerra ou de perigo iminente de guerra;
Resolutos a dar o último passo a fim de abolir a pena de morte em todas as circunstâncias,
Estão de acordo com o que segue:
A pena de morte é abolida. Ninguém pode ser condenado a tal pena e ela também não pode ser executada.
Nenhuma derrogação será autorizada às disposições do presente Protocolo ao título do artigo 15 da Convenção.
