Os Estados membros do Conselho da Europa, signatários do presente
Protocolo,
Considerando o princípio fundamental segundo o qual todas as pessoas são iguais diante da lei e têm direito a uma igual proteção da lei;
Resolutos a tomar novas medidas para promover a igualdade de todos por uma garantia coletiva de uma interdição geral de discriminação pela Convenção de salvaguarda dos Direitos Humanos e das Liberdades Fundamentais, assinada em Roma no dia 4 de novembro de 1950 (doravante denominada “Convenção”),
Reafirmando que o princípio de não-discriminação não impede que os Estados Partes tomem medidas a fim de promover uma igualdade plena e efetiva, à condição que elas se justifiquem de forma objetiva e razoável,
Estão de acordo com o que segue:
1. A fruição de todo direito previsto por lei deve ser assegurado, sem qualquer discriminação, fundada sobretudo sobre o sexo, a raça, a cor, a língua, a religião, as opiniões políticas ou quaisquer outras opiniões, a origem nacional ou social, o fato de pertencer a uma minoria nacional, a riqueza, o nascimento ou qualquer outra situação.
2. Ninguém pode ser objeto de uma discriminação vinda de uma auto-ridade pública, qualquer que seja, sobretudo sobre os motivos mencionados no parágrafo...
