I. Introduction
Regarding the law, should we hold on?
Whether it is actually possible to think
about the law as being in any way tenable is
open to question. I concern myself with the
question of the tenability of the law in con
sidering techniques of ‘parting‘, separating,
deciding and distinguishing. Parting, in this
sense, is a juristic cultural technique.1 I
would like to base the question of the tena
bility of the law not on substances and pred
icates, but on technical processes.
In the literature, various terms are used
in the context of such techniques. Yan
Thomas, for example, chooses the term
“operation“.2 Bruno Latour and others (in
some instances distancing themselves from
the concept of the technique) speak of a fac

Vom Scheiden
I. Einleitung
Was soll man vom Recht halten? Ob das
Recht überhaupt haltbar ist, das steht in
Frage. Ich beschäftige mich mit der Frage
nach seiner Haltbarkeit, indem ich mich mit
dem Scheiden beschäftige. Dem liegt keine
allgemeine These zugrunde, aber eine
besondere. Sie lautet, dass das Recht auch
aufgrund von Techniken halten kann, und
dazu gehören (ausgerechnet, aber auch tra
ditionell schon reflektiert) Scheidetechni
ken. Scheiden ist in diesem Sinne eine juri
stische Kulturtechnik.1 Ich möchte die Frage
nach der Haltbarkeit des Rechts nicht auf
Substanzen und Prädikate zurückführen,
sondern auf technische Vorgänge.
In der Literatur sind für solche Techni
ken unterschiedliche Begriffe im Spiel. Bei
Yan Thomas zum Beispiel wird der Begriff
der Operation gewählt.2 Bei Bruno Latour
und anderen wird (teilweise mit Distanzie
rungen vom Begriff der Technik) von einer

Fabrik gesprochen.3 Es ist hier nicht der
Rahmen, die Gemeinsamkeiten und Unter
schiede zwischen der Kulturtechnikfor
schung einerseits und den Überlegungen
der Rechts und Wissenschaftshistoriker
andererseits systematisch zu entfalten. Im
Vergleich möchte ich zwei Punkte nennen:
Erstens werden die stummen, blinden,
unbegrifflichen oder unterworfenen Proze
duren des Wissen analysiert. Was begriffen
wird unterscheidet sich nicht nur davon,
wie und mit welcher Hilfe begriffen wird.
Das Wissen stützt sich auch auf etwas, was
von der Warte des Wissens aus entweder
abqualifiziert wird oder mit einer Negation
versehen ist. Mit dieser Analyse rücken die
Prozesse ins Feld der Aufmerksamkeit, die
nicht auf ein Konzept „semantischer Macht“
gebracht werden können, weil sie sich auch
im Unbegrifflichen, auch über Begriffe hin
aus oder auch schlicht jenseits des Begriffes
vollziehen.4 Die Sprache soll nicht negiert
werden, es sollen aber die sprachlichen
Limitierungen mit in den Blick genommen
werden. Anders herum soll nicht unterstellt
werden, dass da, wo Recht behauptet wird,
in Wahrheit nur die Macht am Werk ist.
Schon wie im Fall der Sprache interessieren
eher die Limitierungen der Macht. In einem
Teil der Kulturtechnikforschung geht der
Blick auf diese Prozeduren des Wissens
nämlich damit einher, gleichzeitig ein ‚tiefe
res‘ oder ‚höheres‘ Medium zu suchen, in
dem das Recht entweder dichter, kräftiger,
sensibler, kreativer, wahrnehmungs oder
erkenntnisreicher vermittelt und übertragen

tory.3 This is not the place for systematically
exploring the common features and the dif
ferences between cultural technique
research on the one hand and the reflections
of legal and scientific historians on the other.
I would like to state two points by way of
comparison:
Firstly, the dumb, blind, non conceptual
or subjected procedures of knowledge are
analysed. What we understand is not merely
distinct from how and by what means the
understanding is achieved. Knowledge is
also supported on something which is either
dismissed by the keeper of the knowledge or
is issued with a negation. This analysis
brings into the field of our attention the pro
cesses that cannot be reduced to a concept of
“semantic power“ because they are also per
formed in the sphere of the non conceptual,
or outside the sphere of concepts, and even
quite simply beyond the sphere of the con
cept itself.4 Langu age shou ld not be n egated,
but the limitations of language need to be
included in our field of vision. Conversely, it
should not be assumed that where law is
maintained it is in reality only power that is
at work. As in the case of language, it is the
limitations of power that are most interest
ing. For in one part of cultural technique
research, our view of these procedures of
knowledge is associated with the simultane
ous search for a ‘more profound‘ or ‘higher‘
medium in which the law would be con
veyed and transmitted more densely, more
powerfully, more sensitively, more cre
atively or in a more richly perceptive and

würde.5 Diese Suche reicht von der Dia
grammatik und Bildwissenschaft über Theo
rien der Stimme und des Klangs bis hin zu
neuen „Transparenzträumen“ der Compu
terkultur.6 Auf die Suche nach ‚verbesserten
Medien‘ kommt es aber mit dem Blick auf
die Techniken und ihr Zusammenspiel mit
dem Gesetz gerade nicht an. Bemerkenswer
ter ist, dass offensichtlich nicht nur das
Recht, sondern auch Medien limitieren und
limitiert sind. Nicht nur Rechte, sondern
auch Medien lassen sich gegeneinander aus
spielen und wollen übereinander triumphie
ren.
Weil es schließlich um Gesetzestech
niken geht, die an Übertragbarkeiten hän
gen, zielen die Ansätze auf etwas, was man
die dogmatische Seite des Imaginären und
Symbolischen nennen könnte.7 Es geht in
dem Sinne auch um die Fiktionen, die
Gesellschaften reproduzieren, und ihre
Nähe zu den Techniken.
Für die Techniken sind wissenschaftlich
also unterschiedliche Begriffe gebräuchlich.
Um sowohl das Technische als auch das
Scheidende zu betonen, werde ich die Schei
detechniken im Folgenden auch als Monta
gen bezeichnen und der Frage nachgehen,
wie ausgerechnet Montagen fesseln und bin
den. Ich wähle einen Begriff, der im rechts
wissenschaftlichen Kontext und in Bezug
auf den Staat vor allem von Pierre Legendre

knowledgeable way.5 This search extends
from diagrams and pictorial knowledge, via
theories of the voice and of sound, to new
“transparency dreams“ of computer cul
ture.6 However, when we are looking at
techniques and their interplay with the law,
it is precisely not the search for ‘improved
media’ that is important. What is more wor
thy of our attention is that obviously not
only the law but also the media are limiting
and limited. Not only rights but also media
can be played out against each other, each
wanting to triumph over each other.
Because ultimately we are dealing with
techniques of the law which are linked to
things that can be transmitted, our
approaches are aimed at something that we
could refer to as the doctrinal side of the
imaginary and symbolic.7 In that sense we
are also concerned with the fictions that soci
eties reproduce and how close these fictions
are to the techniques.
In the academic world, therefore, differ
ent concepts are used in regard to the tech
niques. In order to emphasise both the tech
nical element and the separating element, I
will in the following also refer to the separa
tion techniques as montages, and I will pur
sue the question of how it is precisely mon
tages that shackle and bind. In so doing I am
selecting a term that is used in the context of
jurisprudence and (in relation to the state) by
