Los Estados498 miembros de la Comunidad de Estados Independientes, designados en lo sucesivo como “Partes”,
Reconociendo que una de las consecuencias del cese de existencia de la Unión Soviética es el problema de la sucesión en materia de archivos de Estado.
Estimando necesario adoptar un planteamiento común para resolver dicho problema.
Atribuyendo una gran importancia a la creación de fondos de archivos válidos en los Estados miembros.
Han convenido en lo siguiente:
Artículo 1
Partiendo del principio de integridad e indivisibilidad de los fondos constituidos como resultado de la actividad de las estructuras estatales superiores del Imperio Ruso y de la Unión Soviética, las Partes no pretenden ejercer los derechos de propiedad sobre ese conjunto de materiales documentales que reposa en los archivos de Estado fuera de sus territorios.
Artículo 2
Las Partes reconocen recíprocamente la realización, conforme a sus legislaciones nacionales, de la transferencia bajo su jurisdicción de los archivos dePage 215 Estado y otros archivos del nivel federal, incluyendo los fondos de archivos sectoriales de la antigua Unión Soviética que se encuentren en su territorio.
Artículo 3
Las Partes tienen derecho a la devolución de aquellos fondos que hayan sido constituidos en sus territorios y que, en distintas épocas, se hayan encontrado fuera de sus territorios.
Artículo 4
En el caso de que no exista la posibilidad de reparto físico de un conjunto de documentos, cada Parte tiene derecho a acceder a esos documentos y obtener las copias necesarias. Al realizar la labor de reproducción y copia de los documentos para los Estados miembros de la Comunidad, los representantes oficiales de los servicios de archivos estatales se beneficiarán de las condiciones de trabajo más favorables.
Artículo 5
Los representantes de los servicios de archivos estatales de las Partes realizarán las consultas regulares, de forma bilateral o multilateral, para examinar las cuestiones de cooperación en ese ámbito.
Artículo 6
Las Partes asegurarán a los investigadores el acceso a los documentos de sus archivos estatales, de conformidad con el orden establecido en sus legislaciones nacionales.
Artículo 7
Las Partes reconocen, en sus territorios correspondientes, la fuerza jurídica de los certificados emitidos por las instituciones de archivos estatales de los demás Estados miembros de la Comunidad.
