La suspensión de la causa, la protección de documentos o informaciones que afecten a la seguridad nacional y comunicaciones e informaciones privilegiadas y la eventual indemnización del detenido o condenado son aspectos procedimentales que con mayor o menor profundidad serán abordados en el ECPI. y tratados en el Proyecto de Reglas de Procedimiento y Prueba.
La suspensión del procedimiento
Como se prevé en el art. 16, el Consejo de Seguridad podrá solicitar con carácter vinculante la suspensión de la investigación o del juicio oral por un plazo no superior a 12 meses. Este precepto recoge con matices la denominada "Propuesta Singapur" por la que se eliminaba del articulado la posibilidad de que cualquiera de los miembros permanentes del Consejo de Seguridad pudiera ejercer su veto a la actuación de la Corte, como venía previsto en el primer proyecto de Estatuto. La posibilidad de "renovar la petición" en los términos de este artículo sólo puede interpretarse como el reconocimiento de una eventual prórroga del plazo máximo, que exigirá, además, la decisión unánime de los Miembros Permanentes del Consejo de Seguridad (art. 27.III de la Carta de las Naciones Unidas).
No se hace mención en el Estatuto de otras causas de suspensión del procedimiento, ni cuándo éstas supondrán la nulidad de lo actuado, propiamente "interrupción". El art. 15 (F) de las RPyPr. del Tribunal Internacional para la ex-Yugoslavia prevé una de estas situaciones motivada por la imposibilidad de uno de los Magistrados que componen la Sala de continuar presente en las sesiones. En esta tesitura, cuando la ausencia prevista sea breve el Presidente de la Sala podrá decidir la suspensión. Ahora bien, si ésta se prolongara tendrá que poner el hecho en conocimiento del Presidente de la Corte quien, una vez designado un nuevo Magistrado para constituir la Sala, decidirá bien la repetición de lo actuado bien la continuación del procedimiento. Sin embargo, cuando la paralización del procedimiento tuvo lugar tras la presentación del caso por las partes (art. 84) o la proposición de medios de prueba (art. 85) su continuación exigirá en todo caso el consentimiento del acusado. Podemos estimar discutible que se reconozca al acusado esa facultad, y sin duda poco funcional trasladar al Presidente de la Corte y no en el de la Sala la decisión acerca de la continuación o no del procedimiento, pero esta regulación, que ya ha demostrado su operatividad, deberá ser tenida en cuenta en la...
