A MODO DE CONCLUSIÓN
Hace ya muchos años Hans Kelsen ponía sobre la
mesa una afirmación que generaría una enorme perple-
jidad y un no menor rechazo:
La determinación del hecho condicionante, por parte
del tribunal, es, por tanto, constitutiva en todo sentido 1.
La tesis, no sin culpa de Kelsen, fue entendida inme-
diatamente como una absurda identificación de poderes
de tipo pantocrátor en la judicatura, una exaltación que
olvidaba que los hechos «son lo que son y no lo que los
jueces dicen que son» 2. Sin embargo, lo hasta aquí di-
cho se condice con otra lectura de las palabras de Kel-
sen. Ciertamente, los hechos son lo que son, pero que
los enunciados acerca de cómo los hechos (como son o
han sido) estén probados parece algo más delicado. De
conformidad a cuanto se vio, cuando los jueces declaran
a ciertos enunciados fácticos como probados, cuando
sostienen que hay prueba suficiente de conformidad con
un estándar legalmente fijado, parecen llevar a cabo un
