La requérante, Mme Güler Kömürcü, est une ressortissante turque née en 1963 et résidant à Istanbul. Elle a été représentée devant la Cour par Me M. Çetinbaş et Me D. Çetinbaş Söner, avocats à Istanbul.

Le parcours professionnel de la requérante

La requérante est journaliste. Elle a travaillé principalement pour les quotidiens Meydan (1990-1996) et Akşam (1996‑2008). Elle est également l’auteur de deux ouvrages parus successivement en 2001 et en 2006.

La procédure pénale engagée à l’encontre de la requérante

En 2007, le parquet d’Istanbul engagea une enquête pénale contre les membres présumés d’une organisation criminelle du nom de Ergenekon, tous soupçonnés de se livrer à des activités visant à renverser le gouvernement par la force et la violence. Selon le parquet, les accusés avaient planifié et commis des actes de provocation tels que des attentats contre des personnalités connues du public et des attentats à la bombe dans des endroits sensibles comme les locaux de sanctuaires ou de hautes juridictions. Ils auraient ainsi cherché à créer une atmosphère de peur et de panique dans l’opinion publique et par là même à installer un climat d’insécurité, de manière à ouvrir la voie à un coup d’État militaire.

Le 22 janvier 2008, la requérante, soupçonnée d’appartenance à l’organisation Ergenekon, fut arrêtée et placée en garde à vue.

Le 25 janvier 2008, la requérante comparut devant le juge assesseur, qui ordonna sa mise en liberté provisoire. Il décida en outre d’interdire à la requérante de sortir du territoire.

Par un acte d’accusation du 14 juillet 2008, le procureur de la République d’Istanbul engagea devant la cour d’assises une action pénale contre les membres présumés de l’organisation, dont la requérante ; il requit la condamnation de l’intéressée principalement au motif de son appartenance à l’organisation Ergenekon. Selon le procureur de la République, la requérante avait porté assistance à l’organisation susmentionnée en dissimulant les activités de celle-ci et en manipulant l’opinion publique.

Le 18 avril 2011, la requérante forma un recours visant à la levée de l’interdiction de sortie du territoire appliquée à son encontre.

Par une décision du 28 avril 2011, la cour d’assises d’Istanbul rejeta ce recours.

Par un arrêt du 5 août 2013, la cour d’assises d’Istanbul rendit son verdict dans l’affaire Ergenekon et, le 3 avril 2014, elle publia un arrêt motivé, long de 16 798 pages. Elle condamna la requérante à une peine d’emprisonnement de sept ans et six mois en vertu de l’article 314 § 2 du code pénal combiné avec l’article 5 de la loi no 3713 relative à la lutte contre le terrorisme, la reconnaissant coupable d’être membre de l’organisation illégale précitée.
