Ausencia ab initio de referencia a los derechos fundamentales (CECA, unión aduanera, Mdo. interior...).
Sentencia Handelsgesellschaft (1970): "El respeto de los derechos fundamentales es parte integrante de los principios generales del Derecho cuyo respeto garantiza el Tribunal".
Sentencia Nold (1974): "El Tribunal se inspirará en las tradiciones constitucionales comunes a los Estados miembros y no puede permitir medidas incompatibles con los derechos fundamentales reconocidos y garantizados por las Constituciones de estos Estados".
Jurisprudencia UE reconociendo de forma explícita una serie de derechos fundamentales, parte integrante del ordenamiento jurídico comunitario: Derecho a un juicio justo, principio de irretroactividad en las normas penales, derecho a la intimidad, derecho a la libertad de pensamiento, conciencia y religión, derecho a la libertad de expresión, derecho de libertad de reunión y asociación, derecho a la tutela judicial efectiva...
Artículo 6.1 TUE: "La Unión se basa en los principios de libertad, democracia, respecto de los derechos humanos y de las libertades fundamentales y el Estado de Derecho, principios que son comunes a los Estados miembros".
Artículo 6.2 TUE: La Unión respetará los derechos fundamentales tal y como se garantizan en el CEPDHLF (Roma, 4 de noviembre de 1950)".
