FILOSOFÍA ANALÍTICA DEL DERECHO

1. INTRODUCCIÓN A LA FILOSOFÍA DEL DERECHO ANALÍTICO

La filosofía analítica del derecho positivo, tal como yo la veo, se basa en dos

fundamento s principales: uno meta-filo sófico y otro ontológico-jurídico.

(i) El presupuesto meta-filosófico —común a la filosofía contemporánea

de orientación empir ista (inaugurada por Got tlob Frege y por Bertrand

Russell)— es que la filosofía no es una peculiar forma de conocimiento

del mundo, con su propio método u objeto, sino es, simplemente, el

análi sis lógico del lenguaje.2

Este punto de vista fue expresado de la forma más nítida posible por el

primer Wittgenstein, en el Tractatus Logico-Philosophicu s (1922, 39, 44):

4.0031. All philosophy is “Critique of language” [...] 4.111. Philosophy

is not one of the natural sciences. (e word “philosophy” must mean

something which stands above or below, but not beside the natural
