Si es así, (como el divino Platón ha escrito) que las palabras, mío y tuyo, que no conciernen más que a la Señoría privada, cuya pose-sión es real y evidente, son sin embargo, causas de guerra, peleas y procesos, ¡cuánto más debe causar y generar la señoría pública que no es sino un Derecho intelectual y una autoridad que tenemos sobre las personas libres y sobre las cosas poseídas por otro! Puesto que si la posesión de esta autoridad es difícil de evidenciar, su título y su Derecho son aun más difícil de fundamentar en la razón. Porque estas señorías, habiendo sido desde el principio establecidas de forma confusa por la fuerza y la usurpación, ha sido imposible aportarles después un orden en tal confusión, el asignarle un derecho a esta fuerza y regularla, todo por la razón de esta usurpación.
[3] ¿No valdría más aportar (quien pueda/quien pudiera!) un orden seguro y asignarle una regla uniforme, con el fin de que los señores [feudales] y súbditos supiesen lo que le correspondiese, sin confusión e incertidumbre, que dejar, en esta materia de las señorías y sus justicias, que la fuerza domine a la justicia y la usurpación a la razón?
[6] Por tanto, la señoría, con este significado general, es definida como poder en propiedad: Definición corta pero que se compone de [el término] poder que es común a los señores, a los oficios y de [el término] propiedad que distingue las señorías de los oficios, cuyo poder es sólo por función o ejercicio y no en propiedad, como la de las señorías. [...]
En cuanto a su división, la señoría tiene dos tipos, a saber, la señoría pública y la privada. La pública consiste en la superioridad y autoridad que hay sobre todas las personas o sobre todas las cosas, y que siempre le es propia al señor [feudal]. En cambio, la superioridad que tiene [7] el simple oficial no es más que de ejercicio [...] Y esta especie de Señoría es llamada pública, porque ella no puede ser ejercida más que por personas públicas.
En cuanto a la señoría privada, es la verdadera propiedad y disfrute de algo y es llamada privada porque concierne el derecho que cada particular tiene sobre su cosa.
