Participation of victims i n the proceedings under rule 89
1. For the purpose s of rule 89 and subjec t to rule 102 a vict im shall m ake a writ ten
application to the Regi strar who shall develop sta ndard forms for that purpos e which
shall be approved i n accordance with regulat ion 23, sub-regulation 2. These s tandard
forms shal l, to the extent possible, be made av ailable to vic tims, g roups of victi ms,
or intergovernment al and non-governmenta l organi zations, which m ay assist in
their diss emination, a s widely as possible. T hese standard fo rms shall , to the extent
possible, be used by v ictims.
2. T he standard forms or other applicat ions described in sub-regu lation 1 shall contain,
to the extent possible, the fol lowing information:
(a) The identity a nd address of the vic tim, or the addr ess to which the v ictim
requests all com munications to b e sent; in case the appl ication is presented
by someone other than t he victi m in accordance wit h rule 89, sub-rule 3, the
identity and addre ss of that person, or the address to wh ich that person requests
all commun ications to be sent;
(b) If the application is pr esented in accordance with ru le 89, sub-rule 3, evidence of
the consent of the vic tim or evidence on the situ ation of the victim, bei ng a child
or a disabled person , shall be presented together with t he application, either i n
writi ng or in accordance with rule 102;
(c) A descript ion of the harm suffered resu lting from the commission of a ny crime
within t he jurisdiction of t he Court, or, in case of a vic tim being an organ ization
or institut ion, a description of any dir ect harm as described i n rule 85 (b);
(d) A description of the inc ident, including its loc ation and date and, to the
extent possible, the identit y of the person or per sons the vict im believes to be
responsible for the ha rm as described in ru le 85;
(e) A ny relevant suppor ting docu mentation, includi ng names and addre sses of
witness es;
(f) Information as to why the pers onal interests of the vict im are affected;
(g) Information on t he stage of the proceedi ngs in which t he victi m wishes to
participate, and , if applicable, on the relief sought;
(h) In formation on the extent of legal representat ion, if any, which is envisaged by
the victi m, including the names a nd addresses of potential leg al representatives,
and inform ation on the vict im’s or victims ’ f‌inancia l means to pay for a legal
representative.
3. Vict ims applying for participat ion in the trial and/or appeal proc eedings sha ll, to the
extent possible, make t heir application to the Registr ar before the start of the stage of
the proceeding s in which they want to part icipate.
4. The Registrar may reque st furt her informat ion from vict ims or those pres enting an
application in accorda nce with rule 89, sub-r ule 3, in order to ensu re that such application
