Regulation 9

Term of off‌ice

1. The term of off‌ice of judg es shall commence on t he eleventh of March fol lowing the

date of their elect ion.

2. The term of off‌ice of a judge elected to r eplace a judge whose term of of f‌ice has not

expired sha ll commence on the date of hi s or her election and sha ll continue for the

remainder of the ter m of his or her predecessor.

Regulation 10

Precedence

1. In the exercise of their judic ial func tions, the judges, i rrespect ive of age, date of

election or lengt h of service, are of equal st atus.

2. The Pre sident, the First Vice-President and the Second Vice-Pr esident, while holding

these off‌ices, sha ll take precedence over all other judg es.

3. Judges shall ta ke precedence according to the date of t he commencement of their

respective ter ms of off‌ice.

4. Judges whose ter ms of off‌ice begin on the same date sha ll take precedence according

to seniority of ag e.

5. A judge who is re-elected i n accordance with article 36, pa ragraph 9 (c), or art icle 37,

paragraph 2, sha ll retain his or her precedence.

Regulation 11

The Pr esidency

1. The members of the Presidency sha ll attempt to achie ve unani mity in a ny decision

taken in car rying out thei r responsibilities u nder article 38, parag raph 3, failing which

any such decision sh all be taken by majority.

2. In the event that a member of t he Presidency is u navailable or d isquali f‌ied, his or

her responsibil ities as a member of the P residency shal l be carried o ut by the next

available judge hav ing precedence in accordance with reg ulation 10.

3. In exceptiona l circum stances such as i n an emergency, where there is a ne ed for the

Presidency to act a nd where it is not possible for all three member s of the Presidency

to act together, the members of t he Presidency who ar e immediately av ailable may

take the action re quired.

4. In the event that the P resident, the First Vice-President a nd the Second Vice-President

are unavai lable or disqualif‌ied, the f unctions of the President shall be c arried out by

the next avai lable judge having precedence in accordance w ith regulation 10.
