1. INTRODUCCIÓN
El interrogatorio, pese a algunos esfuerzos para revitalizarlo 1, ha entrado
en crisis como medio de prueba. Es posible incluso que acabe desapareciendo
de la práctica habitual ante el abrumador valor superior que tienen a efectos de
convicción las actuales pruebas biológicas y tecnológicas, pero también las que
implican otros saberes científicos bastante más fiables que escuchar hablar a una
persona intentando averiguar intuitivamente si dice la verdad. Hay que darse
cuenta de que hasta hace muy poco tiempo, particularmente en los procesos
penales, no teníamos mucho más que reo, víctima y testigos. Pero hoy disponemos
de bastantes más materiales probatorios de muy alta calidad científica. En estas
condiciones, un proceso basado en la prueba obtenida a través de la simple
palabra de los citados sujetos es poco menos que una farsa sólo apta para los
todavía crédulos en el siglo XXI 2.

Pese a todo ello, uno de esos interrogatorios todavía parece relevante: el de
los menores de edad. Ello es así porque no es tan sumamente sencillo que esté
preparado, como ocurre recurrentemente con el interrogatorio de los mayores
de edad, y si lo está, debe descubrirse ese relevante hecho en el proceso, porque
resulta ser crucial. Pero lo cierto es que existen algunos delitos, como vamos a ver,
que solamente se descubren a través del relato del menor, como ocurre con los
abusos sexuales de que puede haber sido víctima en situaciones de clandestinidad.
Hay veces que no existe otro rastro que ese testimonio, y por ello es preciso
examinarlo con el mayor cuidado, obteniendo el testimonio cuanto antes 3.
Sin embargo, tampoco hay que tratarlo a través de una suerte de credibilidad
automática 4 que, de hecho, ni siquiera está extendida entre la sociedad al
considerarse en general como poco fiable el relato de un testigo vulnerable 5. Los
menores tienen una memoria frágil 6 y también mienten, o poseen un recuerdo
alterado de la realidad que les puede llevar a creer acaecidos hechos que jamás
sucedieron 7, con mayor facilidad que un adulto, de hecho, siendo especialmente
vulnerables a ser guiados 8 en las respuestas si ya fueron abusados previamente,
poseyendo una superior dificultad a decir “no” 9. En etapas tempranas de la
vida, distinguir entre realidad e imaginación no es sencillo. Incluso los sueños
se entremezclan con lo realmente acontecido, y lo imaginado puede tener una
potencia lo suficientemente poderosa como para alterar el relato de la realidad 10.
