LA PRECARIEDAD LABORAL DE LA GENTE DEL MAR

1. INTRODUCCIÓN
Los términos “gente de mar” o “marino” designan a toda persona que
esté empleada o contratada o que trabaje en cualquier puesto a bordo de
un buque al que se aplique el Convenio sobre el Trabajo Marítimo,
(2006). Este instrumento jurídico determina que todos los buques de
arqueo bruto igual o superior a 500 GT que efectúen viajes internacio-
nales y de arqueo bruto igual o superior a 500 GT que enarbolen el
pabellón de un Miembro y operen desde un puerto, o entre puertos, de
otro país, obligatoriamente deben estar en posesión de un Certificado
de Trabajo Marítimo y una Declaración Laboral Marítima.
En consideración a este espacio de trabajo, se estudian las condiciones
de trabajo de la gente del mar, en el marco jurídico fijado de forma
internacional y conforme a los lineamientos entregados por los organis-
mos y comités internacionales.
Analizadas las condiciones de trabajo se determina que la gente del mar
aún está sometida a prestar sus servicios personales en condiciones in-
hóspitas, insalubres e inseguras.
