La capacidad jurisdiccional de los
tribunales españoles para conocer delitos
contra el medio ambiente
cometidos en aguas antárticas

Resumen: El ordenamiento español afirma la capacidad jurisdiccional de los tribuna-
les españoles para conocer de delitos cometidos por ciudadadanos españoles
fuera del territorio nacional en una serie de supuestos. Entre otros: cuando
el hecho sea punible en el lugar de ejecución, salvo que ello sea innecesa-
rio en virtud de un acto jurídico internacional; y cuando así lo imponga un
acto jurídico internacional. A estos efectos procesales, el Tribunal Supremo
(TS) español no considera las aguas marinas antárticas de modo diferente
a otras aguas de alta mar. No tiene en cuenta la excepcionalidad jurídica de
la Antártida ni el especial compromiso asumido por España como Parte
Consultiva del Tratado Antártico. El TS busca únicamente un acto jurídico
internacional que imponga la persecución penal del ilícito, sin considerar la
posible existencia de algún acto jurídico internacional que haga innecesaria
la doble incriminación. Así sucedió en 2016 en el Asunto Vidal Armadores.
La sentencia despertó interés por tratarse de un asunto de pesca ilegal, no
por tener lugar en la Antártida. Pero continúa siendo el pronunciamiento de
referencia. A falta de nuevos desarrollos jurídicos internacionales, sólo una
mayor sensibilidad –y quizá comprensión– acerca del compromiso interna-
cional asumido por España para la protección medioambiental antártica po-
drá provocar un cambio legislativo o jurisprudencial.

Abstract: The Spanish legal system affirms the jurisdictional capacity of the Spanish
courts to hear crimes committed by Spaniards outside the national territory
in a series of cases. Among others: when the act is punishable in the place of
execution, unless it is unnecessary under an international legal act; and when
so it is required by an international legal act. For these procedural purposes, the
Spanish Supreme Court does not consider Antarctic waters differently from
other high seas waters. It does not take into account the legal exceptionality
of Antarctica or the special commitment assumed by Spain as a Consultative
Party to the Antarctic Treaty. It seeks an international act that imposes criminal
prosecution of the offense, without assessing the existence of an international
act that makes dual criminality unnecessary. This happened in 2016 in the Vidal
Armadores case. The ruling delicted great interest because the case was about
illegal fishing, not because it took place in Antarctica. But it continues to be the
reference ruling. In the absence of new international legal developments, only
a greater sensitivity –and perhaps understanding– regarding the international
commitment assumed by Spain for Antarctic environment protection will be
able to provoke legislative or jurisprudencial change.

1. INTRODUCCIÓN
En diciembre de 2016 el Tribunal Supremo español (en adelante TS) se pronun-
ció sobre la capacidad jurisdiccional de los tribunales españoles para conocer de
determinado delito cometido en aguas antárticas1. Se trataba de un asunto de pesca
