RESUMEN
El artículo analiza el “derecho al agua” en la jurisprudencia
de la Corte Interamericana de Derechos Humanos en el
marco de justiciabilidad directa y autónoma de los DESCA.
Al indicar las debilidades argumentativas más relevantes
de esta línea jurisprudencial, se enfoca en las consecuen-
cias que ha tenido en el reconocimiento de la justiciabili-
dad directa y autónoma de un “derecho al agua” ante este
tribunal interamericano. Para ello, destaca el Caso Comu-
nidades Indígenas Miembros de la Asociación Lhaka Honhat,
y cómo se derivó este derecho al agua en una operación
de segundo grado, a partir de las normas contenidas en la
Carta de la OEA.

ABSTRACT
The article analyzes the “right to water” in the jurispru-
dence of the Inter-American Court of Human Rights with-
in the framework of direct and autonomous justiciability
of economic, social, cultural and environmental rights. By
indicating the most relevant argumentative weaknesses of
this line of jurisprudence, it focuses on the consequenc-
es it has had on the recognition of the direct and auton-
omous justiciability of a “right to water” before this in-
ter-American court. To this end, the Case of Indigenous
Communities Members of the Lhaka Honhat Association
stands out, and how this right to water was derived in a
second-degree operation, from the norms contained in the
OAS Charter.
