Having regard to the above application lodged on 20 February 2014,

Having regard to the formal declarations accepting a friendly settlement of the case,

Having deliberated, decides as follows:


The applicant, Mr Vasile Botomei, is a Romanian national, who was born in 1964 and lives in Bacau. He was represented before the Court by Ms M. Hartingher, a lawyer practising in Bacau.

The Romanian Government (“the Government”) were represented by their Agent, Ms C. Brumar, from the Ministry of Foreign Affairs.

The applicant complained under Article 3 of the Convention about the conditions of his detention in the Bacau police detention facilities.

On 9 December 2014 and 21 January 2015 the Court received friendly settlement declarations signed by the parties under which the applicant agreed to waive any further claims against Romania in respect of the facts giving rise to this application against an undertaking by the Government to pay him 3,000 euros to cover any pecuniary and non-pecuniary damage as well as costs and expenses, which will be converted into the national currency of the respondent State at the rate applicable on the date of payment, and will be free of any taxes that may be applicable to the applicant.
