[3] las leyes no son menos necesarias en las Repúblicas que los bordes en los ríos [...]. [4] Entre las leyes, sin embargo, las fundamentales son inquebrantables y como los Estados están construidos sobre su firmeza, aquellos que intentan hacerlas tambalear a golpes son criminales públicos y los enemigos más declarados de su patria.
[5] I. Es a favor de las leyes fundamentales que me declaro en este discurso, para hacer ver que están por encima de la autoridad de los Reyes y que no sólo los Estados Generales pueden impunemente tratar de vulnerarlas, por las consideraciones que pueden sacarse de las diversas resoluciones acaecidas por los desórdenes de estos tiempos. Hay que examinar estos dos puntos, uno tras otro. Puesto que la autoridad real no subsiste más que sobre los fundamentos que los fundadores de las Monarquías han establecido, es evidente, en consecuencia de esta suposición infalible, que cuando los reyes comienzan a alterar estos fundamentos de su trono, al mismo tiempo, los vulneran. Que no podrían atentar contra estos establecimientos fundamentales de sus monarquías sin arriesgarse a ver su poder arrasado por la falta o por la debilidad de los pivotes que la hacen brillar a los ojos de sus pueblos.
[6] Sin duda, los monarcas no pueden extender su autoridad hasta este punto si no es por la tiranía y que al mismo tiempo que tratan de destruir la base de los fundamentos esenciales para la subsistencia de sus Estados, dispensan a sus súbditos de la obligación que tenían de obedecerle, porque no la debían más que a condición de que no se alejasen ellos mismos de la dependencia que estaban obligados a tener respecto de la soberanía de estas leyes. He aquí la razón simplemente esbozada. La historia está, sin embargo, enteramente conforme con este diseño.
[8] Digamos, pues, de forma intrépida tras estas razones y tras estas autoridades, que las leyes fundamentales están por encima de
